MisterJ77 Transportation Inc is a registered, licensed, and auto motor carrier (DOT#3372529) (MC#1081410) with the U.S. Department of Transportation.
This agreement is between MisterJ77 Transportation Inc and the customer:
General Refund and Cancellation
(a) You may cancel your shipping order 24 hours prior to the pick-up date of your vehicle/shipment at zero cost to you with no cancellation fee.
(b) Your full deposit will be refunded to you in its entirety.
(c) If a customer’s order has been confirmed and the customer decides to cancel on the day of the pickup day, a cancellation fee (30% of the total shipping cost) will apply. Our cancellation fee is implemented to compensate for the loss of truck space, fuel, and “dead” mileage driven.
(d) All cancellations must be via phone, text, or email 24 hours prior to the pick up of your vehicle/shipment/load.
(e) Customers should be aware that MisterJ77 Transportation Inc has the right to cancel an order at any time.
Pickups and Deliveries
(a) MisterJ77 Transportation Inc cannot assure a specific driver/carrier/truck/trailer.
(b) Driver cannot pick up or deliver a vehicle/shipment/load (with the exception of trailers) at residential locations due to commercial truck restrictions. The driver will pick up and deliver the vehicle/shipment at a nearby ample, safe, and legally allowed commercial truck-friendly location (Walmart, Target, Home Depot, Lowe’s, etc.) to load and unload vehicles/shipment.
(c) Port pickups and deliveries are subject to additional charges of $250 to $650 in certain ports. Customers must inform the transport team member if it’s a port pickup or delivery order.
(d) Customers must assign someone on their behalf and notify MisterJ77 Transportation Inc of who that person will be in the event the customer is unavailable to release and/or accept vehicle/shipment delivery.
(e) In the event that a customer/assigned person is unable to release or accept a vehicle/shipment, the customer is liable for a small rescheduling fee and storage fee.
Times and Dates
(a) MisterJ77 Transportation Inc provides approximate pickup and delivery updates. ETA’s are just approximate times/dates and serve the customer as a general guide to the status of their vehicle/shipment.
(b) MisterJ77 Transportation Inc is not responsible for delays in transit due to unexpected truck mechanical issues, road conditions, weather conditions, or any other unforeseen delays.
(c) MisterJ77 Transportation Inc will not be responsible for any financial loss/damage due to delays of any cause. MisterJ77 Transportation Inc is not responsible for any car rental costs or any other type of delay accommodations.
Vehicle/Shipment Preparation
(a) Customers are responsible for preparing the vehicle/shipment for transport. Any racks or luggage should be removed otherwise specified by the transport team member. The vehicle must be in working running condition unless noted on the shipping order quote. Preferably, the vehicle should be under ½ tank of gas, ¼ tank of gas ideally. If the vehicle/shipment is not ready for transport, customers acknowledge a $100/hr. standby fee is applicable after 2 hours.
(b) Customers are liable for any damage or loss to an object or person caused by an attached or loose part of the vehicle/shipment.
(c) MisterJ77 Transportation Inc is not responsible for any kind of mechanical or anything in relation to operating vehicle parts.
(d) Alarms must be disarmed or otherwise provide instructions on how to disarm the alarm to the transport agent and the driver/carrier at pickup. Driver is authorized to disable/silence the alarm in the event the alarm goes off.
(e) If the vehicle/shipment is different than expected (number, dimensions, condition, etc.) the customer is liable for a rescheduling fee, cancellation fee, or rate adjustment.
Personal Items
(a) We do allow personal items weighing under 75 pounds within the vehicle. Any other personal items weighing over 75 pounds must be discussed prior to pick up with a MisterJ77 logistics coordinator or with the driver at the time of pickup, an extra fee may apply.
(b) MisterJ77 Transportation Inc is not responsible for any loss of personal items in the vehicle or any damaged items due to the transportation of the vehicle.
(c) Customers are responsible for disabling or removing toll pass devices from vehicles. MisterJ77 Transportation Inc is not responsible for any toll charges due to toll pass devices left in vehicles.
(d) The driver can refuse to transport the vehicle/shipment with items that are considered unlawful contraband. Some illegal items include; money, guns, ammunition, explosives, live pets, or any other related illegal items.
Inoperable/Non-Running Vehicles
(a) Inoperable/Non-Running vehicles are subject to additional fees. Fees can range anywhere from $250 at the minimum for small compact vehicles and up to $1250 for larger vehicles. If a rollback/tow is required, the customer is fully responsible for those fees. Please consult with the transport team member for the estimated charge.
(b) In the event the vehicle is inoperable before pickup or becomes inoperable while loading or in transit and it is not noted on the shipping order form, the customer is fully responsible for the fees applicable to transport inoperable vehicles.
(c) Fees will be due at delivery to MISTERJ77 TRANSPORTATION INC after the final inspection of the vehicle.
(d) MisterJ77 Transportation Inc is not responsible for any inoperable/non-running fees in the event vehicles become inoperable/non-running before pickup or while in transit.
Oversize and Modified Vehicles
(a) Customers must disclose/inform MisterJ77 Transportation Inc prior to pickup of the vehicle/shipment on the following items; oversize vehicles, oversize wheels, lift kits, racks, limos, low clearance, or any simple modification on the vehicle/shipment for proper costs.
(b) In the event MisterJ77 Transportation Inc is not informed (prior to pick up) of any of the items mentioned above, the driver may refuse to transport the vehicle/shipment due to odd-size modifications that may damage the vehicle/shipment or risk cargo.
(c) If the driver does transport the vehicle/shipment, customers are responsible for all fees associated with the transport. Fees will be due at delivery to the driver.
(d) MisterJ77 Transportation Inc is not responsible for any permits, pilot cars, oversize and modified, or associated fees.
Carrier Bill of Lading/Inspection Report
(a) Driver and customer are to make a careful inspection of the vehicle/shipment and note on the bill of lading/inspection report any pre-existing damage. Driver and customers are to acknowledge the condition of the vehicle/shipment at both pickup and delivery locations.
(b) In the event the driver does not have a bill of lading/inspection report, it is the customer’s sole responsibility to request a copy prior to pickup and delivery. It is totally at the customer’s discretion to ship the vehicle/shipment without a copy of the bill of lading/inspection report.
(c) The order is subject to all terms and conditions and the bill of lading/inspection report of the actual driver.
Vehicle/Shipment Damage
(a) In the event any negligent damage occurred during the shipping, customers must contact MisterJ77 Transportation Inc's logistic manager and must be notified via phone, text, or email before signing any paperwork or accepting a vehicle/shipment.
(b) It is the customer’s responsibility to inspect and go over the vehicle/shipment with detail at both pickup and delivery. Any vehicle/shipment damage that can be directly linked to negligence by the assigned driver must be detailed on the bill of lading/inspection report and acknowledged by both the driver and customer regardless of weather conditions or time of day.
(c) A signed bill of lading/inspection report without any damage notations serves to verify that the customer and/or assigned person has received the vehicle/shipment in the same condition it was at the time of pickup and that MisterJ77 Transportation Inc and its drivers are relieved of any further responsibility.
(d) Customers should submit in writing directly to the driver’s office a detailed noted bill of lading/inspection report of the negligent damage attached with clear images/pictures of the damage and a couple of estimates within 5 days of the vehicle/shipment acceptance to initiate any motion of the issue. MisterJ77 Transportation Inc in good faith will support the customers in this case if an issue may occur.
(e) Vehicles/Shipments whose values are higher than the general market value, MisterJ77 Transportation Inc suggests that customers transport their vehicle/shipment in a single car enclosed or open car carrier. Customers must purchase extra motor cargo insurance to cover any custom parts or modifications on the vehicle.
(f) MisterJ77 Transportation Inc is not responsible for any type of damages caused by weather conditions, or broken parts of the vehicle/shipment due to worn parts of the vehicle/shipment. Customers should maintain personal insurance for this purpose.
Form of Payment at Delivery
(a) CASH, CREDIT CARDS, ZELLE, CASH APP, WIRE TRANSFER, OR CERTIFIED BANK CHECK (made payable to MISTERJ77 TRANSPORTATION INC) are acceptable. Money orders are NOT accepted. THERE ARE NO EXCEPTIONS.
(b) If the transport balance is not paid prior to or at pick up, or at the time of delivery in the form of the above-mentioned payment forms the customer acknowledges the vehicle/shipment is subject to be placed in a storage facility at vehicle owner's expense until the transport balance has been fully paid.
(c) In the event the customer is unable to pay the remaining balance in any of the forms mentioned above or is unable to accept the vehicle/shipment, the customer is responsible for storage fees and any re-delivery fees.
Claims
(a) Any disagreement, claim, or controversy arising from these terms and conditions, performance or breach thereof, shall be subject to the jurisdiction of Bronx County in New York.
(b) MisterJ77 Transportation Inc and the customer acknowledges and agrees to waive any right to jurisdiction of this matter at any other location other than Bronx, NY.
(c) MisterJ77 Transportation Inc is not responsible for claimed damage caused by a subcontracted driver/carrier.
Liability Disclaimer for Vehicle Transport
1. Damage incurred due to personal items left in the vehicle.
2. Damage to boots, caps, or any other related covering canvas.
3. Damage to antennas, audio equipment, or phone equipment.
4. Damage to vinyl or cloth over 1-year-old.
5. Damage to the undercarriage, tie downs, breaks, exhaust system, suspension, wheel bearings, or alignment. MisterJ77 Transportation Inc and the assigned driver are not responsible for any of these items, because no evaluation of such items is done during inspection.
6. Damage sourced to leaking fluids, in relation to, brake fluid, transmission fluid, motor oil, steering fluid, and radiator coolant, or any other related leaking fluids not described in this section.
7. Damage to battery or freezing cooling system.
8. Damage due to mother nature.
9. Damage due to flying objects including rock chips or debris on the road.
10. Damage not noted at the pickup or delivery locations due to weather or poor lighting conditions.
Liability Disclaimer for RV, 5th Wheel and Trailer Transport
Customers must prepare and verify the RV/Trailer is road worthy and ready for transport prior to pick up. This includes inspecting and/or replacing tires, wheels, bearings, braking system, electrical, and disconnecting all utility lines. If the RV/trailer is not ready for transport, customers acknowledge a $200/hr standby fee is applicable after 1 hour.
Insurance does not cover damage caused by a tire blowout or any interior damages including, but not limited to fixtures, drawers, appliances, etc.
The driver may, in good faith and to the best of his ability, make an effort to resolve general or common trailer issues such as replacing a tire or battery.
Any mechanical, electrical, flat, or blown tires, including damage to the trailer and unforeseen costs resulting from the previously mentioned, will be the sole liability of the owner.
The driver will make every effort to accommodate the owner in contacting any roadside services if needed.
Should a mechanical, electrical, or tire failure occur, the driver will move the unit to the safest location possible and contact the owner immediately.
In the event the RV/trailer becomes inoperable while in transit and as a result requires repairs that will delay our transit time, the owner acknowledges they are subject to a $300 daily fee to cover the driver’s salary, hotels, schedules, and other expenses.
The driver will pick up and deliver the trailer at a designated, ample, safe, and legally allowed location (RV park, storage space, legal driveway, or street).
If the travel trailer is different than expected (number, dimensions, condition, etc.) the customer is liable for a rescheduling charge/fee, cancellation charge/fee, or rate adjustment.
